[ARCHIVED] Majority of State Experiencing Ongoing Drought Conditions

Lexington, a Department of Environmental Protection Northeast Regional Office (DEP NERO) Community, remains in a drought. As such, photos of a dry perennial stream taken after May 1, 2022, may not be used to overcome the presumption of its perennial status, per 10.58(2)(a)1.d. 

Further, photos of dry stream taken before May 1, 2022 for this purpose, must also not be taken during drought conditions and always check the Past Drought Status page https://www.mass.gov/info-details/drought-status#past-droughts-and-declaration- to see if older photos were taken during a declared drought before submitting as evidence.
